1. Membership Agreement
1.1 Your membership contract is with Factory Gym (Essex) Ltd.
1.2 Your membership commences on the date agreed at sign-up.
1.3 By accepting these Terms, you confirm that all information provided during registration is accurate, complete and up to date.
1.4 These Terms, together with your membership agreement and pricing plan, form the entire agreement between you and us.
1.5 Membership is personal to you and may not be transferred, assigned, shared or used by any other person.
2. Membership Fees & Payments
2.1 Membership fees are payable in advance as agreed at the time of joining.
2.2 Payments are collected via our authorised payment provider.
2.3 If a payment fails, we reserve the right to suspend access to the gym until any outstanding balance has been cleared.
2.4 You are responsible for ensuring your payment details remain valid and up to date.
2.5 We reserve the right to review and amend membership fees upon giving reasonable notice.
3. Minimum Term & Cancellation
3.1 If your membership includes a minimum term, you agree to remain a member for that period unless cancellation is permitted under these Terms or required by law.
3.2 After any minimum term has expired, membership will continue on a rolling basis unless cancelled in accordance with your membership agreement.
3.3 Membership cancellations must be submitted via the method specified at sign-up or through your membership account.
3.4 A statutory 14-day cooling-off period applies to memberships purchased online. Where gym facilities have been used during this period, a reasonable deduction may be made from any refund due.
3.5 We may suspend or terminate your membership if you breach these Terms or behave in a manner that endangers others, damages property or harms the reputation of the gym.
4. Access & Use of Facilities
4.1 Access is permitted only to the registered Member.
4.2 You must comply with all gym rules, safety notices, signage and staff instructions at all times.
4.3 We reserve the right to temporarily close the gym or restrict access for maintenance, repairs, cleaning, events or circumstances beyond our reasonable control.
4.4 No refund or compensation will be provided for temporary closures where reasonable notice has been given, except where required by law.
4.5 Membership accounts, QR codes, PIN codes, access fobs or any other access credentials must not be shared with another person.
4.6 Any member found providing unauthorised access to a non-member may have their membership suspended or terminated immediately.
4.7 CCTV operates throughout the facility for security, member safety, crime prevention and protection of property.
5. Member Conduct
5.1 You must behave responsibly and respectfully towards staff, contractors and other members.
5.2 You must:
- Wear appropriate, clean training clothing and footwear.
- Re-rack weights and return equipment after use.
- Use equipment only for its intended purpose.
- Follow all safety instructions and notices.
- Respect the comfort, safety and privacy of other members.
5.3 You must not:
- Use the gym under the influence of alcohol or drugs.
- Engage in aggressive, abusive, threatening or dangerous behaviour.
- Damage equipment intentionally or through misuse.
- Photograph or film other members without their consent.
- Use the facilities for commercial personal training or coaching without prior written permission.
- Allow non-members access to the gym.
5.4 We reserve the right to suspend or terminate membership for serious or repeated breaches of these Terms.
6. Health, Safety & Induction
6.1 You must complete any health declaration and/or Physical Activity Readiness Questionnaire (PAR-Q) honestly before commencing training.
6.2 You must inform Factory Gym (Essex) Ltd immediately of any medical condition, injury, illness or change in health that may affect your ability to exercise safely.
6.3 If you answer "Yes" to any health question, you may be required to obtain medical clearance from a GP or suitably qualified healthcare professional before participating in gym activities.
6.4 You acknowledge that Factory Gym is a strength-training and bodybuilding facility where heavy free weights, resistance machines and high-intensity training regularly take place.
6.5 Participation in physical exercise carries inherent risks of injury which cannot be completely eliminated.
6.6 If you are inexperienced, not confident using gym equipment or unsure how to train safely, you should request a gym induction before commencing exercise.
6.7 If you decline an induction, you confirm that you are competent to use gym equipment safely and accept responsibility for ensuring equipment is used correctly.
6.8 If you are unsure how to use equipment safely at any time, you must stop immediately and seek assistance from a member of staff.
6.9 Members are responsible for exercising within their own physical capabilities and should seek medical advice where appropriate.
6.10 Except where caused by our negligence or breach of legal duty, participation in activities and use of facilities is undertaken at your own risk.
7. Personal Property
7.1 You bring personal belongings into the gym at your own risk.
7.2 Except where caused by our negligence or breach of legal duty, we accept no responsibility for loss, theft or damage to personal property.
7.3 Lockers are provided for convenience only and do not imply acceptance of liability.
7.4 Unclaimed property left on the premises may be removed, disposed of or donated after a reasonable period.
8. Liability
8.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability which cannot lawfully be excluded.
8.2 Subject to Clause 8.1, we shall not be liable for any indirect or consequential loss arising from your use of the facilities.
9. Data Protection
9.1 Factory Gym (Essex) Ltd processes personal data in accordance with UK GDPR and the Data Protection Act 2018.
9.2 We collect personal data necessary to administer your membership, including contact details, payment information, attendance records and relevant health information provided in your PAR-Q.
9.3 Health information is treated as special category data and processed for health, safety and contractual purposes.
9.4 Full details of how your personal data is collected, processed and protected are contained within our Privacy Policy.
9.5 Personal data may be processed by our membership management software provider and payment providers for the purpose of administering memberships.
10. Social Media & Online Conduct
10.1 Members must not engage in conduct, whether in person or online, that is abusive, threatening, discriminatory or likely to damage the reputation of Factory Gym (Essex) Ltd.
10.2 Serious breaches may result in suspension or termination of membership.
11. Changes to Terms
11.1 We reserve the right to update these Terms where reasonably necessary for legal, regulatory or operational reasons.
11.2 Members will be notified of any material changes.
12. Governing Law
12.1 These Terms are governed by the laws of England and Wales.
12.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Using gym equipment, machinery and facilities can be physically demanding and carries risks that cannot be completely eliminated. These risks include the possibility of personal injury.
Rules of Use
You must:
- Act responsibly and sensibly at all times.
- Not participate if you are unwell, under the influence of alcohol or drugs, or have been advised by a medical professional not to exercise.
- Follow all safety warnings and instructions displayed within the gym or given by a member of staff.
- Ask a member of staff if you are unsure how to use any equipment safely.
- Obtain medical advice if you are in any doubt about your ability to participate safely.
- Wear appropriate clothing and footwear at all times.
- Return all weights, dumbbells and equipment after use.
- Inform Factory Gym (Essex) Ltd of any medical condition, injury, illness or change in health that may affect your ability to exercise safely.
Except where caused by our negligence or breach of legal duty, participation in any activity within the gym is entirely at your own risk.

You are responsible for using all equipment safely and as directed.
You must behave sensibly and follow all safety instructions to avoid injury to yourself or others.

3. Disclaimer for Loss or Damage to Property
Except where caused by our negligence or breach of legal duty, we are not responsible for any theft, loss, damage or destruction of personal belongings brought onto the premises.
Lockers are provided for convenience only and do not imply acceptance of liability.
4. CCTV
CCTV operates within the gym for the purposes of security, crime prevention, member safety and the protection of property.
Acknowledgement and Acceptance
By becoming a member or using our facilities, you confirm that:
- You have read and understood this Disclaimer Notice.
- You voluntarily accept the risks associated with exercise and gym use.
- You agree to use the facilities responsibly and in accordance with all safety instructions.
- You understand that participation in physical exercise carries an inherent risk of injury.
